He advises the parties that he intends to conduct a fact-finding hearing today to determine whether the Trump Administration defied his court orders.

Judge Boasberg asks the DOJ how many planes departed the US at any point on Saturday carrying any people being deported solely on the basis of Trump’s EO.
 
DOJ refuses to answer, but will say that 2 flights took off after the court entered its order and that they aren’t “relevant” to this case.
 
DOJ claims national security and diplomacy prevents them from disclosing further info to the Court.
 
Judge continues to press the DOJ for flight info.
 
DOJ refuses to disclose info & won’t even explain why they cannot tell the court in camera (outside of public earshot).
 
DOJ merely says that the flights took off before the court entered its order.

* How many people on those planes were in that AEA EO category
* Into which countries did those planes land

* At what time did those planes land
* At what time were those individuals subject to the AEA EO transferred into foreign custody
 
Court also orders the DOJ to include in its written filing by Noon tomorrow why the DOJ thinks it doesn’t have to disclose any of the above info.
 
DOJ then argues that the written order from the Court was issued 40 minutes after the Court announced its oral ruling. DOJ claims that “in good faith” it only viewed Boasberg’s *written* order as binding, not what he orally pronounced in court.
 
Judge asks the DOJ: But I told you to notify your clients *immediately* that any planes that have taken off & have affected individuals on them must be turned around and those individuals must be brought back to the US.
 
Judge: So because that wasn’t in the Minute Order it didn’t apply to you?
 
DOJ replies that because the oral language was not included verbatim in the written order, it was ok to ignore what the court announced in court from the bench.
